How do I declare driver posting in the IMI system?
Drivers performing cabotage or cross-trade in another member state are considered posted workers. Before the operation, the company files a posting declaration in the European Commission IMI system. Below you see the steps and the exemptions.
Short answer
- You create the operator account in the European Commission IMI system, in the road transport posting section.
- You complete the declaration with the company, transport manager and driver details plus the host state.
- The declaration is filed before the operation starts and may cover a period of at most 6 months.
- The driver keeps a copy of the declaration in the vehicle, together with the transport documents.
- After the posting, at the request of the host state authority you send the supporting documents through IMI within the set deadline.
What the law says (in brief)
- Directive (EU) 2020/1057 sets the specific posting rules for road transport drivers.
- Cabotage and carriage between two foreign states (cross-trade) fall under the posting regime.
- Bilateral transport and transit are, as a rule, exempt from posting.
- The posted driver is entitled to the minimum wage and working conditions of the host state.
- Supporting documents are sent through IMI, not by email to the foreign authority.
Practical example
Example: a company in Oradea sends a driver to run three cabotage trips in France. Before the first loading, it files an IMI declaration valid for 6 months for that driver and for France. The driver has a copy of the declaration on the phone. For the days worked in France, the company pays at the French minimum level, not the Romanian one.
Common mistakes
- Filing the declaration after cabotage has started, so the check finds an undeclared operation.
- Declaring only the main state although the driver also runs cross-trade in another.
- Letting the declaration expire at 6 months and continuing operations without renewal.
- Being unable to prove the days actually worked in the host state, so you cannot justify the pay.
How 4transports helps
- Each trip records driver, vehicle, origin and destination, so you reconstruct the days worked in each state.
- The driver record holds the licence and certificate with expiry dates; you file and keep the IMI declaration in the IMI platform.
- 4transports does not do GPS tracking and does not connect to IMI.
